SiC Audio, Visuals & Tools

Welcome to SiC Audio, Visuals & Tools ("SiC," "we," "us," or "our"), an independent creative practice operated by Juan David Gómez Sicard, an individual creator based in Colombia. These Terms and Conditions ("Terms") govern your access to and use of davidsicardrock.com, including all browser-based tools, applications, plugins, software, downloads, digital content, and related services made available through the website (the "Service"). This document also incorporates our Acceptable Use rules (Section 9 below) as part of a single governing agreement.

By accessing, browsing, or using any part of the Service — including launching a tool, uploading a file, downloading content or otherwise interacting with the site — you acknowledge that you have read, understood, and agree to be legally bound by these Terms and by our Privacy Policy and Cookie Policy.

If you do not agree, you must immediately discontinue use of the Service.

1. Nature of the Service Provider

"SiC Audio, Visuals & Tools" is a trade name under which Juan David Gómez Sicard, an individual creator based in Colombia — offers the Service, all ownership, intellectual property rights, and legal responsibility for the Service rest with him personally. References to "we," "us," or "our" refer to him individually.
 

2. Eligibility

By using the Service, you represent that you are legally capable of entering into a binding agreement in your jurisdiction, will comply with all applicable laws, and — if using the Service on behalf of an organization — have authority to bind that entity to these Terms.

3. Description of the Service

The Service provides browser-based creative software — audio and visual processing tools, HTML5 applications, plugins, and related digital resources.

Unless a specific tool states otherwise, all processing happens locally in your own browser. Files you process through compatible tools are never uploaded to, stored on, reviewed by, or accessible from our servers. Certain non-tool areas of the site (downloads, memberships, analytics, contact forms, third-party integrations) may involve external services — see our Privacy Policy for details.
 

This website is built and hosted on Wix.com; your use is also subject to Wix's own applicable platform policies, which nothing here overrides.

4. License to Use the Service

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for lawful purposes. This does not transfer ownership of any software, source code, design, algorithm, trademark, or other material provided through the Service. Detailed software-specific license terms (restrictions on redistribution, reverse engineering, etc.) are set out in our Software License Agreement, which forms part of this agreement.

5. Intellectual Property

Except for Your Content (Section 6), all elements of the Service — code, design, graphics, logos, text, documentation— are owned by Juan David Gómez Sicard, trademark, and other applicable law. Except where expressly permitted in writing, you may not copy, modify, distribute, sell, reverse engineer, or create derivative works from any part of the Service.

6. Your Content

"Your Content" means any file, image, audio, text, or other material you upload, import, or process through the Service. You retain full ownership of Your Content; we claim no rights over it or over outputs you generate. Because most tools process files locally, we generally do not receive, review, store, or have any technical ability to access Your Content.

You are solely responsible for:
- confirming you own or hold the necessary rights to any file you process;
- ensuring your use complies with copyright, trademark, privacy, publicity, and data-protection law;
- reviewing any output before publishing or relying on it.

Automated or algorithmic tools (e.g., vectorization, audio analysis) perform technical processing only; we do not guarantee the accuracy or fitness of their output, and you're responsible for validating results before use.

7. No Monitoring, No Legal Advice

Because most tools process files entirely in your browser, we generally have no technical ability to monitor Your Content, and our inability to review it does not reduce your legal responsibility for it. Nothing on the Service constitutes legal advice; if you're unsure whether you have the right to use particular content, consult qualified counsel.

8. Assumption of Risk

You use the Service entirely at your own risk and assume full responsibility for every file you process, every output you create, and every consequence of publishing or distributing it. Availability of a tool never implies legal permission or endorsement of any particular use.

9. Acceptable Use

You agree to use the Service only for lawful, legitimate purposes. Without limitation, you must not use the Service to:

 

Intellectual property & identity
- process, reproduce, or distribute copyrighted or trademarked material without authorization, or remove copyright/attribution notices;
- impersonate any person or organization, or falsely claim authorship, ownership, or affiliation;
- misuse another person's identity, likeness, voice, or personal information, or otherwise violate someone's privacy or publicity rights.

Security & technical abuse
- introduce malware or other harmful code, attempt unauthorized access, exploit vulnerabilities, or otherwise interfere with the Service's security or infrastructure;
- scrape, crawl, or use bots/automated tools to access, extract, or monitor the Service, except where expressly authorized in writing.

 

Commercial & general misuse
- resell access to the Service, redistribute or commercialize the Software outside the permissions in the License Agreement, or operate unauthorized mirrors;
- use the Service to defraud, deceive, harass, or otherwise unlawfully harm any person, or to facilitate any illegal activity.

The availability of a feature never implies permission to use it for a particular purpose. We may investigate suspected violations and, at our sole discretion and without prior notice, suspend or terminate access, remove content where applicable, or cooperate with lawful requests from competent authorities.

​

10. Prohibited Technical Conduct

Except where prohibited by applicable law, you may not reverse engineer, decompile, or attempt to discover the source code of the Service; bypass security mechanisms; or access parts of the Service not intended for public use. Violations may result in immediate termination and potential civil or criminal liability.

11. Suspension and Termination

We may suspend, restrict, or permanently terminate your access at any time, without prior notice, if we reasonably believe you've violated these Terms, created legal or security risk, or if required by law. Termination doesn't limit any other remedy available to us.

12. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Juan David Gómez Sicard / SiC Audio, Visuals & Tools from any claims, damages, or expenses (including reasonable attorneys' fees) arising from Your Content, your use or misuse of the Service, or your violation of these Terms or applicable law. This obligation survives termination of your use.

13. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, to the fullest extent permitted by law. We don't warrant that the Service will be uninterrupted, error-free, or that outputs will be accurate, complete, or fit for your intended purpose.

14. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, consequential, or special damages arising from your use of the Service, Your Content, or any output generated through it — including data loss, lost profits, or third-party claims. Nothing here excludes liability that cannot legally be excluded; where it can't, liability is limited to the maximum extent the law allows.

15. Third-Party Services & Memberships

Paid memberships are currently facilitated through Patreon; billing and account management are handled directly by that platform under its own terms.

16. Force Majeure

We are not liable for delay or failure to perform caused by events beyond our reasonable control (outages, government action, third-party service failures, etc.).

​

17. Modifications & Changes to These Terms

We may modify, suspend, or discontinue any part of the Service, and may revise these Terms, at any time and without prior notice. Updates take effect upon publication; continued use after that constitutes your acceptance.

18. Governing Law

These Terms are governed by the laws of the Republic of Colombia. Any dispute is subject to the exclusive jurisdiction of the competent courts of Bogotá D.C., Colombia, unless applicable law requires otherwise.

​

19. Severability & No Waiver

If any provision is found unenforceable, the remaining provisions stay in full force. Our failure to enforce any provision is not a waiver of it.

 

20. Entire Agreement

These Terms, together with the Privacy Policy, Cookie Policy, and Software License Agreement, constitute the entire agreement between you and Juan David Gómez Sicard regarding the Service, and supersede all prior understandings. The separate SiC Gaming Terms and Conditions govern browser games specifically, and take priority over this document on points specific to Games.

BY ACCESSING OR USING ANY PART OF THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY THESE TERMS. IF YOU DO NOT AGREE, YOU MUST NOT ACCESS OR USE THE SERVICE.
